In centuries past, using natural medicines like herbs and other plants were all people had to turn to. When modern-day pharmaceutical medicines came along, people were glad. However, cannabidiol (CBD) and tetrahydrocannabinol THC seem to be the most promising.

Until recently, marijuana and hemp were both illegal to grow or use in the United States. The Hemp Farm Bill was passed in 2018, and it removed hemp from the Schedule I Controlled Substance list. Marijuana remains illegal on the federal level because it is high in THC and causes intoxication. It was finally determined that hemp did not contain enough THC to cause intoxication. However, it is very high in CBD, which is thought to have many medicinal benefits. CBD products are regulated by the Food and Drug Administration (FDA) and the Department of Agriculture (DOA).

What Is CBD Used For?

Even though research and studies are continuing to determine the conditions CBD could be beneficial to treat, there has already been conclusive evidence that it does help treating seizures from some types of epilepsy. So far, the FDA has only approved one drug called Epidiolex that treats these seizures.

Some studies show CBD may reduce inflammation and pain. For those that suffer from arthritis, pain associated with inflammation can be things they deal with daily. When using CBD, inflammation may be reduced, which in turn may reduce pain.

According to the many people that use CBD, there also seems to be evidence that it helps relieve nausea. This could be helpful for those undergoing chemotherapy cancer treatments. Others claim it can help with insomnia, anxiety, and post-traumatic stress syndrome (PTSD). Many people say using CBD products for these conditions have fewer side-effects than prescription medications.

Why Is CBD Sometimes Illegal?

Since the 2018 Farm Bill was enacted on the federal level, CBD products are legal nationally as long as they do not exceed 0.3% THC and come from hemp. However, this may not apply in every US state. So far, 11 states have legalized marijuana for recreational use. This means that CBD products that are derived from marijuana and exceed 0.3% THC are legal in those states.

There are currently 33 states that have medical marijuana programs. In those states, it is necessary to have a recommendation from a licensed physician to treat a medical condition with marijuana or CBD with a high THC content. Eligible medical conditions can vary depending on the state. If your medical condition is on the state list, you will have to be approved before you are allowed to obtain and use CBD with more than 0.3% THC or marijuana. Gaining access to these treatments usually comes from a state-led dispensary.

Most states that have not legalized marijuana treat CBD products that are higher than 0.3% in THC the same as they would marijuana. You could be fined or even face jail time, depending on the state laws. Even though most states still consider marijuana illegal, many have chosen to decriminalize it. This means you would probably only pay a fine for possession of a small amount of marijuana or CBD with high THC content.

Current CBD Laws In New Jersey

In New Jersey, using CBD derived from hemp with 0.3% THC or less is legal to buy and use in the state. Marijuana remains illegal, as well as CBD products derived from marijuana. However, just like the neighboring state of Vermont, New Jersey also has a medical marijuana program. The New Jersey Compassionate Use Medical Marijuana Act was signed into law by former Governor Jon Corzine on his last day in office on January 18, 2010.

Just like the many other states that offer a medical marijuana program, you must have a recommendation from a doctor to be considered. If approved, you will be issued a medical marijuana card from the state. Some of the conditions that are covered in the program include cancer, Crohn’s disease, glaucoma, chronic pain, seizures, and others.
