Along with the passage of this legislature came SB 491, which made a first-time offense of possession of 10 grams or less of marijuana a misdemeanor. It is only punishable by a fine. However, possessing larger quantities is considered a felony.

Luckily for Missouri residents, recreational marijuana has been legalized unlike the state of Arkansas where fines and jail time are still serious matters. 

Missouri voters approved Amendment 2 on November 6, 2018. This ballot initiative intended to legalize medical marijuana use when it was recommended by state-licensed physicians. 

Amendment 2 created regulations for licensing and certification and went into effect on December 6, 2018.

In Missouri, patients that have a state-issued medical marijuana identification card along with a secure facility are allowed to grow their personal cannabis. 

The patient must provide the address of their garden, a patient license number, payment of fees, and a statement that allows the DHSS to inspect their garden. 

There are more applying rules, but this means that it could be much easier and more economical for Missouri residents that use CBD derived from marijuana to do so more economically.

Why Is CBD Sometimes Illegal?

It is documented that the use of marijuana and hemp for medicinal purposes can be traced back thousands of years. It wasn’t until the 1930s that marijuana and hemp were made illegal in the United States. 

This happened because marijuana caused intoxication, so naturally, hemp was thrown into the same category and was made illegal too. Today, hemp is in a different category than marijuana because it does not cause intoxication.

Even though marijuana and hemp are cousins in the same plant family, and they share the same cannabinoids, their THC amounts are not equal. 

Marijuana contains far more tetrahydrocannabinol (THC) that causes intoxication. Hemp contains far more cannabidiol (CBD) that does not cause intoxication. 

Hemp is legal everywhere in the United States today, since it does contain THC, but it is still heavily regulated by the Food and Drug Administration (FDA and the Department of Agriculture (DOA).

Some CBD products are legal in some places, and some are not. This all depends on whether the CBD comes from the marijuana plant or the hemp plant, and the reason is the THC content. 

According to the 2018 Hemp Farm Bill, hemp cultivation and CBD products derived from hemp were made legal nationwide as long as they contain 0.3% THC or less. CBD derived from marijuana contains much more THC and is not legal nationwide.

However, there have been 11 states thus far that have totally legalized marijuana for recreational and medicinal use. At least 33 states have a medical marijuana program. In these states, marijuana-derived CBD products are legal with a higher THC content, either with or without a state card or certification. 

Where marijuana is still illegal, marijuana-derived CBD requires a recommendation from a doctor and state approval to obtain them. In these states, it is only possible to get marijuana CBD from dispensaries licensed by that state.

Even in some states where marijuana is still illegal, many of them have chosen to decriminalize it. 

This means you can be caught with small amounts of marijuana or marijuana-derived CBD products, and it will be a misdemeanor with only a small fine and no jail time.

  • Registration and permits are valid for 3 years as long as compliance is met. 
  • Annual fees are $750 per application.
  • Each application is only applicable to one acre of land.
